ORDINANCE REVISING AND AMENDING CHAPTER 18
OF
THE MUNICIPAL CODE OF THE CITY OFKANKAKEE
Whereas, it is the finding of the City
Council of Kankakee, Illinois, that a revision and amendment of the provisions of
the Municipal Code respecting Health is necessary and required for the health
and welfare of the residents of the City; Now, Therefore,
Be it Ordained
by the Council of the City of
Section 1. Chapter 18
Repealed. Chapter 18 of the Municipal
Code is herewith repealed.
Section 2. New
Chapter 18. A new Chapter 18,
entitled Health is herewith adopted as follows:
ARTICLE
I. HEALTH
Sec. 18‑01. Board of Health Generally.
(a) There is hereby established a Board of
Health which shall have jurisdiction, duties and authority as set forth in this
Chapter.
(b) The Board of Health shall consist of the
Code Enforcement officer, the Chief of Police, the Fire Chief, and the
Superintendent of the Department of Water Pollution Control. Any member of the
Board may authorize any subordinate to attend meetings of the Board in his or
her stead upon filing written notice of such delegation with the secretary of
the Board.
(c) The Chairperson of the Board of Health
shall be the Code Enforcement Officer of the City of
(d) The Board shall select one of its
members to serve as secretary who shall maintain the records of the Board. The
term of the Secretary shall be the same as the fiscal year of the City.
Sec. 18-02. Health
Officer.
(a) The Code Enforcement Officer of the City
shall be the Health Officer.
(b) All members of the Board of Health
shall be designated deputy health officers of the
City. In addition thereto, each member of the Board may designate one subordinate
from his department as a deputy health officer, with the consent of the Board,
and the names of all deputy health officer with the consent of the Board, and
the names of all deputy health officers shall be kept on file by the secretary
of the Board and in the office of the Mayor and the office of the City Clerk.
(c) Deputy health officer shall have the
same powers and duties as the Health Officer but shall be subordinate to the
Health Officer in matters pertaining to health.
Sec. 18‑03. Board of Health ‑
Powers and Duties.
The Board of Health shall have the
following powers and duties:
(a) Exercise general supervision over the
public health of the City.
(b) Abate and remove or cause to be removed
all public nuisances as defied by statute or ordinance.
(c) Adopt such sanitary regulations as may
be required to prevent the introduction or spread of any contagious or
infectious disease in the City.
(d) Establish temporary hospitals at times when
the preservation of the public health may require and to employ attendants for
such facilities as may be required.
(e) Employ the services of a physician or
other health care professional as the Board may from time to time require in
the interests of maintenance of the public health.
(f) To perform all other duties and have
all other powers as are provided by law.
Sec. 18‑04. Health Officer ‑
Powers and Duties.
The Health Officer shall have the
following powers and duties:
(a) To carry into effect all orders and
ordinances of the City Council and all orders of the Board of Health relating
to sanitation and public health.
(b) To enforce all laws and ordinances
relating to sanitation and public health.
(c) To examine structures within the City for
violations of statutes, ordinances and other codes relating to sanitation and
public health in accordance with law.
(d) To issue citations against the owner or
owners of and persons in actual possession of any structure in which is
maintained a nuisance as defined by statute or ordinance relating to sanitation
and public health.
(e) To initiate in the name of the City of
Kankakee an action in the Circuit Court for injunction or other relief in
matters relating to sanitation and public health.
(f) To perform all other duties and to have
all other powers as provided by law.
(g) To appoint additional deputy health
officers in addition to those provided in Section 18‑2(b) hereof, and to
set the terms for such additional health officers provided, however, that the
terms of any deputy shall expire on the last day of the fiscal year of the
City.
Sec. 18‑05. Compliance with Orders and Regulations of the Board of Health or
the Health Officer.
(a) It shall be unlawful for any person to disobey
or disregard any lawful order of the Board of Health or the Health Officer in
the execution of their duties and powers.
(b) Violation of this section shall be
punishable by a fine of not less than $50.00 nor more
