ARTICLE I. IN GENERAL

Sec. 32‑01.      Definitions.

 

Words and phrases used in this chapter shall have the meanings respectively ascribed to them in the Illinois Vehicle Code in Chapter 95 ½ of the Illinois Revised Statutes in sections 1‑101 et seq. (Code 1965, Sec. 41.01)

32‑02.  Adoption of certain state law by reference.

 

(a)        The following enumerated sections of Chapter 95 ½ of the Illinois Revised Statutes, exclusive of any provisions thereof relating to the penalties or the punishment to be imposed for violation of such sections, are adopted and by reference made a part of this Code with the same force and effect as though set forth here in verbatim; and the term "this act" wherever used in any such section shall mean this chapter whenever necessary to effectuate the meaning of the section:

(b)         There shall be three (3) copies of Chapter 5 ½ Illinois Revised Statutes available for inspection in the office of the City Clerk. (Code 1965, Sec. 41.02; Ord. of‑5‑20‑68, Sec.2)

 

Sec. 32‑03.      School crossing guards ‑ Vehicles to yield for.

 

(a)        Defined. For purposes of this section, a "school crossing guard" shall be a person stationed at intersections at or near schools for the purpose of conducting school children safely across said intersection and equipped with a sign reading, "Stop."

 

(b)        Vehicles to stop. Whenever a school crossing guard shall enter an intersection and display the said stop sign to traffic approaching said intersection from opposing directions, drivers of vehicles shall stop before entering the nearest crosswalk at an intersection or at a limit line when marked, or, if none, then before entering the intersection, and pedestrians within or entering the roadway shall have the right‑of‑way over vehicles stopped. Drivers shall remain stopped until the school crossing guard shall cease displaying a stop sign at which time said driver may proceed.

 

(c)        Failure to stop prohibited. It shall be unlawful to fail to stop when directed to do so by a school crossing guard.

 

(d)        Penalty for violation. A person convicted of violating the provisions of this section shall be fined in an amount not less than fifty dollars ($50.00) and not more than five hundred dollars ($500.00). (Ord. No. 82‑30, Sec. 1, 10‑18‑82)

                               ARTICLE II. OPERATION OF VEHICLES GENERAL.

 

Sec. 32‑18.      Driving on sidewalks and in safety zones.

 

No driver of a vehicle shall drive within any sidewalk area, except at a permanent or temporary driveway, nor into or upon any portion of a roadway marked as safety zone. (Code 1965, Sec.41.09)

 

Sec. 32‑19.      Driving through procession.

 

(a)        No driver of a vehicle shall drive between the vehicles comprising a funeral or other authorized procession while they are in motion and when such vehicles are conspicuously designated as required in this section. This provision shall not apply at intersections where traffic is controlled by traffic control signals or police officers.

 

(b)        A funeral composed of a procession of vehicles shall be identified as such by the display upon the outside of each vehicle of a pennant of a type designated by the Police Department.

 

(c)        Each driver of a vehicle in a funeral or other procession shall drive as near the right‑hand edge of the roadway as practical and follow the vehicle ahead as close as is practical and safe. (Code 1965, Sec. 41.10)

Sec. 32‑20.      Traffic not to be obstructed.

 

No vehicle shall be operated or allowed to remain upon any street in such a manner as to form an unreasonable obstruction to the traffic thereon. (Code 1965, Sec. 41.12)

 

Sec. 32‑21.      Stopping in intersection.

 

No driver shall enter an intersection or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to accommodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians, notwithstanding any traffic‑control signal indication to proceed. Sec. 32‑22.      Trucks on Fifth Avenue.

When signs are erected giving notice thereof, no person shall operate any truck or motorcycle upon South Fifth Avenue from Court Street to Station Street between the hours of 6:00 p.m. and 6:00 a.m. This section shall not apply to police vehicles, fire vehicles, ambulances and emergency vehicles of public utilities when on emergency calls.

 

The Superintendent of the Environmental Services Utility is hereby authorized and directed to place appropriate highway signs designating the prohibition contained in this section. (Code 1965, Sec. 41.33)

 

Sec. 32‑23.      Reckless driving.

 

Any person who drives any vehicle on any street, road or public way within the corporate limits of the City of Kankakee with a willful or wanton disregard for the safety of persons or property is guilty of reckless driving. (Ord. No. 76‑58, Sec. 1, 9‑20‑76)

Sec. 32‑24.      Starting stopped vehicle.

 

No person shall start a vehicle which is stopped, standing, or parked unless and until such movement can be made with reasonable safety. (Ord. No. 76-59, Sec.1, 9‑20‑76)

Sec. 32‑25.      Motor vehicles equipped with muffler exhaust system.

 

Every motor vehicle driven or operated upon the streets, roads and public ways within the corporate limits of the City of Kankakee shall at all times be equipped with an adequate muffler or exhaust system in constant operation and properly maintained to prevent any excessive or unusual noise. No such muffler or exhaust system shall be equipped with a cut out bypass or similar device. No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise of such vehicle above that emitted by the muffler originally installed on the vehicle. Sec. 32‑26.      Lamps required on motorcycles, other motor vehicles; illumination of registration plate.

 

(a)        When upon any street, road or public way situated within the corporate limits of the City of Kankakee every motorcycle shall at all times exhibit at least one lighted lamp, showing a white light, commonly known as the driving lamp, visible for at least five hundred (500) feet in the direction the motorcycle is proceeding. All other motor vehicles shall, during the period from sunset to sunrise, or at any other time when visibility is so limited as to require the use of lights for safety, exhibit two (2) such lighted driving lamps showing white lights or lights of a yellow or amber tint, visible for at least five hundred (500) feet in the direction the motor vehicle is proceeding. Parking maps may be used in addition to but not in lieu of any such driving lamps. Every motor vehicle, trailer or semi trailer shall also exhibit at least two (2) lighted lamps, commonly known as trail lamps, which shall be mounted on the left rear and right rear of the vehicle so as to throw a red light visible for at least five hundred (500) in the reverse direction, except that a motorcycle or truck tractor or road tractor manufactured prior to January 1, 1968 need be equipped with only one such lamp.

 

(b)        Either a tail lamp or a separate lamp shall be so constructed and placed as to illuminate with a white light at rear registration plate when required and render it clearly legible from a distance of fifty (50) feet to the rear. Any tail lamp or tail lamps together with any separate lamp or lamps for illuminating rear registration plate, shall be so wired as to be lighted whenever the driving lamps or auxiliary driving lamps are required. Sec. 32‑27.      Driving on roadways divided into two or more lanes.

 

Whenever any roadway has been divided into two (2) or more clearly marked lanes for traffic the following rules in addition to all others consistent herewith shall apply:

 

(a)        A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.

 

(b)        Upon a roadway which is divided into three (3) lanes and provides for two‑way movement of traffic, a vehicle shall not be driven in the center lane except when overtaking and passing another vehicle traveling in the same direction when such center lane is clear of traffic within a safe distance, or in preparation for making a left turn or where such center lane is at the time allocated exclusively to traffic moving in the same direction that the vehicle is proceeding in such allocation is designated by official traffic‑control devices.

 

(c)        Official traffic‑control devices may be erected directing specific traffic to use a designated lane or designating those lanes to be used by traffic moving in a particular direction regardless of the center of the roadway and drivers of vehicles shall obey the directions of every such sign.

 

(d)        Official traffic‑control devices may be installed prohibiting the changing of lanes on sections of roadway and drivers of vehicles shall obey the directions of every such device. (Ord. No. 76‑60 Sec 1, 9‑20‑76)

Sec. 32‑28.      Streets and alleys designated as boulevards; truck and/or bus traffic prohibited.

 

The following streets and alleys are hereby designated as boulevards. Truck and/or bus traffic is prohibited as indicated:

 

Alley, between Eighth Avenue and Ninth Avenue from Harbor Street to Park Drive (truck or bus traffic).

 

Alley, between Fifth Avenue and Eighth Avenue from Park Drive to Harbor Street (truck or bus traffic).

 

Cypress Street, between Entrance Avenue and Washington Avenue (truck traffic).

 

Park Avenue, (truck or bus traffic).

Sec. 32‑29.      Truck Routes Established.

 

Truck routes shall be established, as the state highways, designated Class I, Class II and Class III by the State of Illinois, as the Truck Route System.  Trucks will be permitted to travel only on Illinois Routes 17, 45-52, 50 and 115 within the City limits; except that trucks shall be permitted to travel from Route 17 along Nelson Avenue to its intersection with Risser Street and along Risser Street to its intersection with Looker Avenue.  In addition, trucks shall be permitted to use East Gate Road to its intersection with Grinnell Road; Grinnell Road to its intersection with Route 50; Route 50 to its intersection with Hobbie Avenue, thence south along Hobbie Avenue to its intersection with Chestnut Street. ARTICLE III. BICYCLES

DIVISION 1. GENERALLY

 

Sec. 32‑33.      Application of traffic laws.

 

Every person riding a bicycle upon a roadway shall be subject to the provisions of the Code regulating traffic upon the streets of the City applicable to the driver of a vehicle, except as to special regulations of this article and except as to those provisions for the regulations of traffic which, by their nature can have no application. (Code 1965, Sec. 43‑01)

 

Sec. 32‑34.      Use of public streets.

 

The regulations applicable to bicycles shall apply whenever any bicycle is operated upon any street or any public path set aside for the exclusive use of bicycles. (Code 1965, Sec. 43‑02)

 

Sec. 32‑35.      Responsibility of parent or guardian.

 

The parent or guardian of any child shall not authorize or knowingly permit any such child to violate any provision of this article. (Code 1965, Sec.43‑02)

Sec. 32‑36.      Brakes.

 

Every bicycle, when operated upon a highway, shall be equipped with a brake adequate to control the movement of and to stop such bicycle when necessary. (Code 1965, Sec.43‑04)

 

Sec. 32‑37.      Lamps and reflectors.

 

Whenever operated upon any street or highway during the period between sunset and sunrise, every bicycle shall display a white light on the front thereof visible for a distance of not less than five hundred (500) feet, and on the rear thereof shall display a two (2) inch red reflector so designed and maintained as to be visible at all distances within three hundred (300) feet when such bicycle is directly in front of a motor vehicle displaying lawfully lighted headlights. A lamp exhibiting a red light visible for a distance of not less than five hundred (500) feet to the rear may be used in addition to or in lieu of such rear reflector. (Code 1965, Sec. 43‑04)

 

Sec. 32‑38.      Audible signals.

 

No person shall ride a bicycle unless it is equipped with a bell or other device capable of giving a signal audible for a distance of at least one hundred (100) feet, except that no bicycle shall be equipped with nor shall any person use upon a bicycle any siren or whistle. (Code 1965, Sec.43‑04)

 

Sec. 32‑39.      Extra passengers.

 

It shall be unlawful for any person operating a bicycle to carry another person on the same bicycle ahead of the operator.  (Code 1965, Sec. 43‑05)

 

Sec. 32‑40.      Care in Riding.

 

No bicycle shall be ridden in such manner as to be dangerous to persons or property. (Code 1965, Sec. 43‑05)

 

Sec. 32‑41.      Speed.

 

No person riding a bicycle shall ride faster than is reasonable and proper having regard to the safety of the rider and others. (Code 1965, Sec. 43‑05)

 

Sec. 32‑42.      Clinging to moving vehicle.

 

No persons riding upon any bicycle shall attach the same or himself to any moving vehicle upon any street or roadway. (Code 1965, Sec. 43‑05)

 

Sec. 32‑43.      Riding abreast.

 

(a)        When two (2) or more persons in a group are operating bicycles, they shall not ride more than two (2) abreast at any time, and if riding abreast, shall ride close together so that they do not occupy more of the width of the street or roadway than an automobile would while traveling in the same direction.

 

(b)         When two (2) or more persons in a group are operating bicycles at any time when lights are required to be displayed by bicycles, they shall not ride abreast, but ride in single file.   (Code 1965, Sec. 43.05)

 

Sec. 32‑44.      Carrying articles.

 

No persons riding a bicycle shall carry any package, bundle or article which prevents the rider from keeping at least one hand upon the handlebars. (Code 1965, Sec. 43.05)

 

Sec. 32‑45.      Trick riding.

 

No rider of a bicycle shall remove both hands from the handlebars or feet from the peddles, or practice any acrobatic or fancy riding on any street, nor shall any person operating a bicycle upon a public highway participate in any race for speed, or endurance contest with any other vehicle, except under permit from and under the supervision of the chief of police, or delegated authority. Sec. 32‑46.      Parking.

 

No person shall park a bicycle upon a roadway in front of a business establishment. Bicycles parked in any alley, in a public driveway, on a sidewalk, or on a public path, must be in such a position as not to interfere with the safety or movement of the vehicular or pedestrian traffic. (Code 1965, Sec. 43.05)

 

Sec. 32‑47.      Dealer's report required.

 

All persons engaged in the business of buying or selling new or secondhand bicycles shall make a written report before the tenth (l0th) day of each month, to the Chief of Police, or delegated authority, giving the name and address of the person purchasing or selling, the description of the bicycle, the number thereof and the registration number, if any. (Code 1965, Sec. 43.06)

 

Sec. 32‑48.      Regulations for rental agencies.

 

Bicycles offered for rent by a rental agency shall be equipped by the rental agency with the lights and other safety equipment required by this article and shall be kept in good and safe working order. Rental agencies shall comply, in all respects with all the provisions of this article and shall be responsible for the conditions of the bicycles they rent. The Chief of Police, or delegated authority shall make periodical inspections of rental agencies to ascertain in that they are complying with the provisions of this article. (Code 1965, Sec. 42.06)

Sec. 32‑49.      Transfer of ownership.

 

It shall be the duty of every person who sells, or transfers ownership of, or junks any bicycle, except dealers, to report within seven (7) days of the date of such sale, transfer, or junking to the Chief of Police, or delegated authority, together with the name and address of the person to whom said bicycle was sold or transferred. It shall be the duty of the purchaser or transferee of such bicycle to apply for the registration thereof within seven (7) days of the sale or transfer as the case may be. (Code 1966, Sec. 32.57)

 

Sec. 32‑50.      Enforcement, impoundment.

 

(a)        The Chief of Police, or delegated authority is hereby authorized and empowered to administer the provisions of this article. The Chief of Police is hereby authorized and empowered to impound for a period of not to exceed thirty (30) days any unregistered or improperly registered bicycle or the bicycle of any person used in violation of any provision of this Code relating to street traffic, insofar as they are applicable, whether operated by the owner or by another at the title of the violation. The action of the Chief of Police in impounding a bicycle, as provided in this section, shall be conclusive and final. The impounding of a bicycle shall not preclude the imposition of any other penalties. (Code 1965, Sec. 43.08)

 

Sec. 32‑51.      Record of violations.

 

The Chief of Police or his delegated authority, shall keep a record of all persons violating the provisions of this Code relating to the use of bicycles, and of the violation committed, and of the registration number, if any, of the bicycle impounded. (Code 1965, Sec. 43.08)

DIVISION 2. REGISTRATION

 

Sec. 32‑57.      Registration Required.

 

Every owner of a bicycle who resides within the City except a dealer in bicycles, and every person residing in the City within ten (10) days after becoming the owner of a bicycle shall make application in writing for registration of every bicycle owned by him, with the Chief of Police, or delegated authority, on the form prescribed by the Chief of Police, or delegated authority. It shall be unlawful for any person to operate an unregistered bicycle on any street, alley or public way in the City. (Code 1965, Sec. 43.03)

Sec. 32‑58.      Application; inspection; refusal to register.

 

The application to register a bicycle shall contain the name of the owner, his address, the trade name of the bicycle, if known, and the color and frame number of the bicycle, if any. The Chief of Police or delegated authority shall inspect each bicycle for which application is made for registration and he may refuse to register any bicycle which is not properly equipped or is in an unsafe condition. (Code 1965, Sec. 43.03)

 

Sec. 32‑59.      Record keeping required.

 

The Chief of Police or delegated authority, shall keep a record of the date of the application for registration, the name of the owner of each registered bicycle, his address, the trade name of said bicycle, if any is known, the color of the bicycle, the frame number if any and the registration number assigned to and affixed upon the bicycle. (Code 1965, Sec. 43.03)

 

Sec. 32‑60.      Marking of number required.

 

The Chief of Police, or delegated authority, shall, upon approval of the condition of the equipment of the bicycle, stamp in a distinguishing manner, the registration number on the frame of the bicycle registered. It shall be unlawful for any person to remove, destroy, mutilate or alter the number on any bicycle frame or the number affixed to any bicycle by the Chief of Police on any bicycle registered pursuant to this division. If the registration number stamped on any bicycle has been destroyed or impaired from any cause, the bicycle shall not be registered. (Code 1985, Sec. 43.03)

 

Sec. 32‑61.      Fee for bicycle registration.

 

The application for registration of a bicycle shall be accompanied by a fee not to exceed fifty cents ($0.50) to be paid in advance at the time of the issuance of the license. Such license shall be transferred when the ownership of such bicycle is transferred. (Code 1965, Sec.43.03)

ARTICLE IV. JUNKED, ABANDONED AND WRECKED VEHICLES

 

Sec. 32‑72.      Definitions.

 

The following definitions shall apply in the interpretation and enforcement of this article:

 

Property.  "Property" shall mean any real property within the City which is not a street or highway.

 

Street or highway.  "Street or highway" shall mean the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.

 

Vehicle.  The term "vehicle" shall mean a machine propelled by power other than human power designed to travel along the ground by use of wheels, treads, runners or slides and transport persons or property or pull machinery and shall include without limitation, automobile, truck, trailer, motorcycle, tractor, buggy and wagon. (Ord. of 7‑18‑66, Sec.1)

 

 

Sec. 32‑73.      Abandonment of vehicles prohibited.

 

No person shall abandon any vehicle within the City and no person shall leave any vehicle at any place within the City for such time and under such circumstances as to cause such vehicle reasonably to appear to have been abandoned. (Ord. of 7‑18‑66, Sec. 2)

 

Sec. 32‑74.      Leaving of wrecked, non-operating vehicle on street prohibited.

 

No person shall leave any partially dismantled non-operating, wrecked or junked vehicle on any street or highway within the City. (Ord. of 7-8-66, Sec. 3; Ord. 93-54, 10-4-93)

Sec. 32-75.      Maintaining or leaving, dismantled, non-operating, etc., vehicles on property prohibited.

 

No person in charge or control of any property within the City, whether as owner, tenant, occupant, lessee or otherwise, shall allow any partially dismantled, non-operating, wrecked, junked or discarded vehicle to remain on such property longer than seventy-two (72) hours.  No person shall leave any such vehicle on any property within the City for longer time than seventy two (72) hours.  This section shall not apply to vehicles in an enclosed building, a vehicle on the premises of a business enterprise operated in a lawful place and manner, when necessary to the operation of such business enterprise, or a vehicle in an appropriate storage place or depository maintained in a lawful place or manner by the City.  (Ord. of 7-18-66, Sec. 5)

 

Sec. 32-76.      Impounding.

 

The Chief of Police or any member of the Police Department designated by him is hereby authorized to remove or have removed any vehicle left at any place within the City which reasonably appears to be in violation of this article, or lost, stolen or unclaimed.  Such vehicle shall be impounded until lawfully claimed or disposed of in accordance with chapter 95 ½, Illinois Revised Statutes, Section 4-200 et seq. (Ord. of 7-18-66, Sec. 5)

ARTICLE V. LICENSES FOR BUSINESS VEHICLES

FOR TRANSPORTING MERCHANDISE

 

Sec. 32-87.      License required for business vehicles.

 

No resident of the City or business located within the City shall operate any truck designated or used in business for the transportation of goods, wares, commodities or merchandise without first securing a license therefore. (Ord. No. 92-29, Sec. 1, 7-6-92)

 

This Sec. shall not apply to any motor vehicle operated solely for personal use. (Ord. No. 86-20, Sec. 1, 5-5-86)

 

Ordinance Number 86-20 and Ordinance Number 92-29 are repealed in their entirety. (Ord. No. 94-59, Sec. 1, 9-19-94) *Cross Reference ‑ Licenses generally, Sec. 21‑1 et seq.; for job, express, transfer or transportation vehicles for hire, Sec. 33 et seq.

 

Sec. 32‑88.      Application.

 

The application for a license required by this article shall state the name of the applicant and the classification of such vehicle as designated by statute for the purpose of securing the vehicle license. (Code 1965, Sec. 32.02)

Sec. 32‑89.      Fee.

 

The annual fee for the license required by this division shall be:

 

(1)        For vehicles having a gross weight of not to exceed eight thousand (8,000) pounds, including weight of vehicle and maximum load, ten dollars ($10.00);

 

(2)        For vehicles having such maximum in excess of eight thousand (8,000) pounds, but not to exceed twelve thousand (12,000) pounds, twelve dollars ($12.00);

 

(3)        For vehicle having such maximum in excess of twelve thousand (12,000) pounds, fifteen dollars ($15.00).   (Code 1965, Sec. 32‑02)

 

Sec. 32‑90.      Licensed sticker or plate.

 

The City shall issue to the licensee licensed under this division, a license sticker or plate which shall be affixed in a prominent place on the exterior of the vehicle when in use in the City. (Code 1965, Sec. 32‑02)

ARTICLE VI.  ONE WAY STREETS

 

Sec. 32‑101.    Movement of traffic on designated streets; procedure for designation.

 

Upon those streets and parts of streets described in section 30‑102, vehicular traffic shall move only in the indicated direction when signs indicating the direction of traffic are erected and maintained at every intersection where movement in the opposite direction is prohibited. The Chief of Police is authorized, after the concurrence of the City Parking Commission and subject to the approval of the City Council, to determine and designate one‑way streets and alleys. (Code 1965, Sec. 41‑21)

 

Sec. 32‑102.    Designation of one‑way streets.

 

In accordance with section 32‑101, traffic shall move only in the direction indicated on the following streets and alleys, and they are hereby designated as one‑way streets or alleys:

 

Alley between Eighth Avenue and Ninth Avenue from Harbor Street to Park Drive, northbound. (Ord. 80-18)

Sec. 32‑113     Designation of preferential streets and yield intersections; signs required; obedience to signs required.

 

The streets and intersections described in sections 32‑114 and 32‑115 are designated preferential streets and yield inter‑sections respectively. Stop signs or yield‑right‑of way signs shall be erected and maintained in conformity with state law at the entrances to the preferential streets described in section 32‑114. Yield‑right‑of‑way signs shall be erected and maintained in conformity with state law at the designated entrances to the yield‑right‑of‑way intersections described in section 32‑115. When such signs are erected, the driver of a vehicle approaching any such stop sign or yield‑right‑of‑way sign shall stop or yield the right‑of‑way in obedience to the sign, unless otherwise directed by a police officer or a traffic control signal. ARTICLE VIII. SIGNS, SIGNALS AND MARKINGS

Sec. 32‑126.    Placement of traffic control devices.

 

When official traffic‑control devices, signs or markings are required to be placed by this chapter or by law, it shall be the duty of the Superintendent of the Environmental Services Utility to cause suitable devices, signs or markings to be placed in such areas, if not so placed by the State Department of Public Works and Buildings. Sec. 32‑127.    Marking crosswalks and safety zones.

 

The Superintendent of the Environmental Services Utility is hereby authorized to maintain, by appropriate devices, marks or lines upon the surface of the roadway, crosswalks at intersections where in the opinion of the Chief of Police there is particular danger to pedestrians crossing the roadway. Sec. 32‑128.    School crossing signals.

 

(a)        For purposes of this section, a "school crossing signal" is a permanently mounted electrically operated signal device equipped with two‑way two (2) color (red and yellow) signal heads, together with a diamond shaped single faced sign reading "School Crossing" by which at predetermined times and when actuated by push button, traffic is directed to stop so as to permit school children to cross the street or highway safely.

 

(b)        Whenever the red lens of a school crossing signal is illuminated by rapid intermittent flashes, drivers of vehicles shall stop before entering the nearest crosswalk at an intersection or at a limit line when marked, or, if none, then before entering the intersection, and pedestrians within or entering the roadway have the right‑of‑way over vehicle so stopped. Drivers of vehicle having so yielded the right‑of‑way to pedestrians entering or within the nearest crosswalk at an intersection may proceed but shall also yield the right‑of‑way to pedestrians within any other crosswalk at the intersection. If a school crossing signal is erected and maintained at a place other than an intersection, the provisions of this section also shall be applicable, except as to provisions which by their nature can have no application.

 

(c)        School crossing signals shall be erected at the following location and if such locations are under the jurisdiction of the State of Illinois Department of Public Works and Buildings, the erection of such signals shall be subject to the approval of such department:

Sec. 32‑129.    Traffic‑control intersections designated; obedience required.

 

The intersections described in this section are designated traffic‑control intersections. When traffic‑control signals are erected and in operation at any such intersection, the driver of a vehicle shall obey the instructions of such signals, unless otherwise directed by a police officer. ARTICLE IX. SIZE, WEIGHT AND LOAD

 

Sec. 32‑140.    Width of Vehicles

 

The maximum width of any vehicle and its load shall not exceed eight feet except as permitted by the Statutes of the State of Illinois, as amended.  (Ord. 07-70)

Sec. 32‑141.    Length of Vehicles   

 

No vehicle, laden, unladen, or with load, and driven on the roads, streets, or alleys of the City of Kankakee shall exceed in length the limitations prescribed by the Statutes of the State of Illinois, as amended.    (Ord. 07-70)

Sec. 32‑142.  Weight.

 

It shall be unlawful to drive on any road, street or alley, located within the municipal boundaries of the City of Kankakee, any motor vehicle with a weight, including load, in excess of that permitted by the Statutes of the State of Illinois, as amended, for driving on improved highways or with the weight distributed in a manner not conforming to such law.

 

Sec. 143.  Weight in excess of permit or license.

 

It shall be unlawful to drive on any road, street or alley, located within the municipal boundaries of the City of Kankakee, any motor vehicle with a weight, including load, in excess of that permitted by the registration, permit or license of the vehicle upon which such load exists.

 

Sec. 144.  Bonds and Bond Forfeiture.

 

All persons charged with a violation of this ordinance, a violation of Chapter 15 of the Illinois Motor Vehicle Code, 625 ILCS 5/25-100 et. seq. or Section 5/401(d) of the Illinois Motor Vehicle Code or any section of this ordinance shall post a cash bond in an amount equal to the amount of the minimum fine established herein or in the Illinois Motor Vehicle Code plus costs in the amount of $25.00 for administrative costs. The Defendant may, in lieu of cash bail, deposit a money order issued by a money transfer service company which has been approved by the Office of the Comptroller of the City of Kankakee.  The money order shall be made payable to the City of Kankakee.

 

If a person who submits a bond or money order is found guilty of or pleads guilty to any offense or fails to appear for a hearing before the Administrative Adjudication Hearing Officer, the Hearing Officer may order the forfeiture of all or part of the bond or money order to the City of Kankakee.

                       

Sec. 145.  Violations; Penalties.

 

Whenever any vehicle is operated in violation of the provisions of Section 140 and 141 herein, any person convicted of such violation shall be fined an amount not less than Fifty Dollars ($50.00) nor more than Five Hundred Dollars ($500.00).

 

Whenever any vehicle is operated in violation of the provisions of Section 142 and/or Section 143 of this chapter, the owner or driver of such vehicle shall be deemed guilty of such violation and either the owner or the driver of such vehicle may be prosecuted for such violation.  Any person charged with a violation of any of these provisions who pleads not guilty shall be present in court for the trial of the charge.  Any person, firm or corporation convicted of any violation of Section 142 and/or Section 143 including, but not limited to, a maximum axle or gross limits specified on a regulatory sign posted in the City of Kankakee shall be fined according to the following schedule:

 

            Up to and including                   2000 pounds overweight           =          $50.00

            from 2001 through                    2500 pounds overweight           =          the fine is $135.00

            from 2501 through                    3000 pounds overweight           =          the fine is $165.00

            from 3001 through                    3500 pounds overweight           =          the fine is $260.00

            from 3501 through                    4000 pounds overweight           =          the fine is $300.00

            from 4001 through                    4500 pounds overweight           =          the fine is $425.00

            from 4501 through                    5000 pounds overweight           =          the fine is $475.00

            from 5001 or                            more pounds overweight           =          the fine shall be computed by assessing $750 for the first 5000 pounds overweight and $75.00 for each additional increment of 500 pounds overweight or fraction thereof.

 

In addition, any person, firm or corporation convicted of four or more violations of Section 142 within any 12-month period should be fined an additional amount of $2500 for the fourth and each subsequent conviction within a 12-month period provided, however, that with regard to a firm or corporation, the fourth of subsequent convictions have been a fourth or subsequent conviction attributable to any one employee-driver. Sec. 146.  Prevention of use of Roads, Streets or Alleys by Overweight Vehicles.

 

The City of Kankakee Police Department is directed to institute and maintain a program

designed to prevent the use of roads, streets, and alleys by vehicles which exceed the maximum weight limits allowed by Section 142, or the statutes of the State of Illinois or which exceed the maximum weight allowed as evidenced by the license plates attached to such vehicle and which license is required by the Statutes of the State of Illinois.  Said program shall include the right to require the immediate removal of the violating vehicle from the roads, streets and alleys of the City of Kankakee and to require said vehicles to come into compliance with said applicable and statutes prior to the vehicle being returned to the roads, streets, or alleys of the City of Kankakee.

Sec. 145.  Prosecution of Ordinance Violation

 

Violations of this article or of the Illinois Motor Vehicle Code relating to overweight trucks, specifically violations of Chapter 15 or Section 5/3-401(d) of the Illinois Motor Vehicle Code, 625 ILCS 5/15-100 et. seq.  And 625 ILCS g/3-401(d) may be decided by the Administrative Adjudication Hearing Officer as set forth in Chapter 36 of the City of Kankakee Municipal Code.

ARTICLE X. SPEED REGULATIONS

 

Sec. 32‑152.    State speed laws - Application; specific alterations designated.

(a)        The state traffic laws regulating the speed of vehicles shall be applicable upon all streets within this City, except as this section, as authorized by state law, hereby declares and determines upon the basis of engineering and traffic investigation that certain speed regulations shall be applicable upon specified streets or in certain areas, in which event it shall be unlawful for any person to drive a vehicle at a speed in excess of any speed so declared in this section when signs are in place giving notice thereof.

 

(b)        It is hereby determined upon the basis of an engineering and traffic investigation that the speed permitted by state law outside of business and residence districts as applicable upon streets in this section is greater or less than is reasonable or safe under the conditions found to exist upon such streets and it is hereby declared that the maximum speed limit shall be as set forth in this section on those streets or parts of streets herein designated when signs are erected giving notice thereof. No person shall operate a vehicle on any of the following streets at a greater speed than that specified:

ARTICLE XI STOPPING, STANDING, AND PARKING

 

DIVISION 1. GENERALLY

 

Sec. 32‑163.    Procedure for leaving motor vehicle unattended:  authority of police to confiscate keys left in vehicles; responsibility for violation.

(a)        No person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine, locking the ignition, removing the ignition key from the vehicle, effectively setting the brake thereon and, when standing upon any grade, turning the front wheels to the curb or side of the highway.

 

(b)        Whenever any police officer shall find a motor vehicle standing unattended with the ignition key in the vehicle, in violation of this section, such police officer is authorized to remove such key from such vehicle and to deliver such key to the police officer in charge of the police station of the City.

 

(c)        The registered owner of a vehicle found in violation of this section shall be held prima facie responsible for any such violation. (Ord. of 7‑3‑67, Sec. 1)

 

Sec. 32‑164.    Taxicab stands.

 

When signs are erected giving notice thereof, no person shall park or stand a vehicle except while loading or unloading, except a taxicab, in any designated taxicab stand. The Chief of Police, with the approval of the City Council, may designate appropriate areas for taxicab stands. (Code 1965, Sec. 41‑22)

 

Sec. 32‑165.    Standing for loading in certain places.

 

During the times specified herein, an operator shall not stand a passenger vehicle for a period of time longer than is necessary for the loading or unloading of passengers, provided such loading or unloading shall not consume more than three (3) minutes, nor shall an operator stand any commercial vehicle for a period of time longer than is necessary to load, unload and deliver material; provided that the loading, unloading and delivery of such materials shall not consume more than thirty (30) minutes, in any of the following places:

 

(1)        In any public alley, during any hour of any day.

 

(2)        At any place not to exceed twenty‑five (25) feet along the curb before the entrance to any hotel during any hour of any day.

 

(3)        At any place not to exceed twenty‑five (25) feet along the curb before the entrance to any theater during the hours said theater is open for business. (Code 1965, Sec. 41‑23)

 

Sec. 32‑166.    Parking position.

 

(a)        No person shall stand or park a vehicle in a roadway other than parallel with the edge of the roadway, headed in the direction of traffic, and with the curbside wheels of the vehicle within twelve (12) inches of the edge of the roadway, except as provided in this section.

 

(b)        Upon those streets which have been marked or signed for angle parking, vehicles shall be parked at the angle to the curb indicated by such mark or signs. The Superintendent of the Environmental Services Utility may erect and maintain suitable signs and place and maintain suitable markings upon the surface of the roadway, requiring the parking of vehicles at any angle to the curb and with the right front wheel within six (6) inches of the curb. Such signs shall not be erected at any place where angle parking will diminish the width of the roadway available for travel to less than twenty (20) feet. (Code 1965, Sec. 41‑24)

(a)        No person shall stand or park a vehicle upon any roadway for the principal purpose of displaying it for sale, or washing, greasing or repairing such vehicle, except repairs necessitated by an emergency.

 

(b)        No person shall operate or park a vehicle on any street for the primary purpose of advertising. (Code 1965, Sec. 41‑26)

 

Sec. 32‑168.    Parking on street to be cleaned.

 

(a)        It shall be unlawful to park any vehicle on any public street or portion thereof in the City at any time when such street is being cleaned. Signs indicating that a street or portion thereof is being cleaned shall be posted twenty‑four (24) hours before the cleaning of the street, and shall be removed after the cleaning of the street is finished.

 

(b)        Any vehicle parked on any public street or portion thereof in the City at any time when such street is being cleaned or parked in any way as to impede the street cleaning process shall be removed or towed away by the Police Department. Vehicles so removed or towed shall be stored in a safe place and shall be restored to the owner or operator of such vehicle upon payment of towing charges. Such payment of towing charges shall not be in lieu of any fines imposed by this Code. (Ord. No. 73‑53, Sec. 1, 9‑4‑73)

 

Sec. 32‑169.    Parking after snowfall.

 

(a)        After a snowfall accumulation of more than two (2) inches has occurred, no person shall park, or caused to be parked any vehicle on the south side of any east‑west street on even numbered calendar days; or on the north side of any east‑west street on odd‑numbered calendar days; or on the east side of any north‑south street on even‑numbered calendar days; or on the west side of any north‑south street on odd‑numbered calendar days until such time as said snowfall accumulation has been cleared, as announced by the Mayor, or his designated representative.

 

(b)        For purposes of this article, Maple Street, from its intersection with Nelson Avenue southeasterly to its intersection with Illinois Route I‑57 shall be deemed an east‑west street; Wall Street, from its intersection with Water Street, northwesterly to its intersection with Illinois Route No. 113 shall be deemed a north‑south street; Enos Avenue shall be deemed a north‑south street; and Moore Street, Wood Court, Country Club Drive, from its intersection with Bourbonnais Street southeasterly to its intersection with Duane Boulevard, and Gordon Avenue, from its intersection with Hickory Street southeasterly to its intersection with the City Limits, shall be deemed east‑west streets; Sunnyside Avenue, Greenview Avenue and Summit Avenue, for the purposes of this article, shall be deemed east‑west streets; and Fifth Avenue, from its intersection with Kennedy Drive, southeasterly to its intersection with the New York Central Railroad tracks, shall be deemed a north-south street.    

 

(c)        This section 32‑169, and subparagraphs contained therein, shall be enforceable pursuant to the provisions of section 32‑181 of this Code.

 

(d)        Any person found to be in violation of this section shall be subject to a fine of not less than twenty-five dollars ($25.00) nor more than two hundred dollars ($200.00) for each such offense. (Code 1965, 41.27; Ord No. 78-8, 2-20-78)

 

Sec. 32-170.    Parking prohibited and restricted in certain parking zones; signs required.

 

When signs are erected giving notice thereof, no person shall park a vehicle at any time upon any of the streets or alleys where parking is prohibited or restricted as described in this division except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control device.  Whenever such designation is made, signs shall be erected and maintained, indicating the appropriate restrictions at the designated locations. (Code 1965, 41.30)

 

Sec. 32-171.    Parking prohibited in certain places.

 

(a)        No person shall stop, stand or park any vehicle upon a street, other than an alley, in such a manner or under such conditions as to leave available less than ten (10) feet of the width of the road way for free movement of vehicular traffic, except that a driver may stop temporarily during the actual loading of passengers or when necessary in obedience to traffic regulations or traffic signs or signals or a police officer.

 

(b)        No person shall park a vehicle within an alley in such a manner or under such conditions as to leave available less than ten (10) feet of the width of the roadway for the free movement of vehicular traffic.

 

(c)        No person shall park any truck, (except pickup trucks), trailer, semi trailer motor home or boat trailer on any City street or alley for a longer period of time than is necessary for the expeditious loading or unloading of said vehicle for a longer period than 2 hours. (Code 1965, 41.28); (Ord. No. 97 - 62, 10-6-97; Ord 04-25 4/19/04).

 

(d)        It shall be illegal for any person to park a motor vehicle at any off-street parking space unless said motor vehicle is parked upon a paved surface or a surface constructed in accordance with Chapter 10, Section 10.02 B et. seq of the Zoning Ordinance of the City of Kankakee.  (Ord. 2003-01)

 

Sec. 32‑171.1  Parking prohibited on terraces; no signs required.

 

(a)        No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with law, or the directions of a police officer, on any terrace except as provided in this section. "Terrace" shall be defined to mean that portion of property located between the curb line and the sidewalk. In areas that do not have curb lines or sidewalks, "Terrace" shall mean that portion of property lying between the edge of the street and the area that would be used for the construction of a sidewalk. (b)        Terrace parking shall be allowed at the following location:  Merchant Street, south side, east one-half block from Sixth Avenue west. (Ord. No. 85-54, Sec. 1, 12-16-85)

 

(c)        That parking signs be erected and maintained at the location described in Section 1 hereof, in conformity with the law. (Ord. No. 85-54, Sec. 2, 12-16-85)

                                           

Sec. 32-171.2  Parking on Illinois Route 17 (Court Street).

 

Parking will be prohibited at the following locations along Illinois Route 17 (Court Street):

Sec. 32‑171.3 Restricting Parking on Streets Bordering Cobb Park

 

No person shall park any vehicle at any time from 9:00 p.m. until 6:00 a.m. on any street bordering Cobb Park on the park side of such street, or either side of Cobb Boulevard where Cobb Boulevard borders Cobb Park and the Kankakee River. (Ord. 85‑47, Sec. 1, 10‑21‑85)

 

Sec. 32‑171.4.     Fire lanes.

 

(a)        Definition. A "fire lane" is defined as an area no less than fifty (50) feet in length and no less than twelve (12) feet in width located at curbside on a public or private way.

 

(b)        Specifications. A fire lane shall be no less than fifty (50) feet in length and no less than twelve (12) feet in width and shall be identified by painted lines outlining said area and shall be further identified by appropriate signs at both ends of the length of said fire lane.

 

(c)        Establishment of fire lanes.

 

(1)        Fire lanes shall be established on public ways by ordinance.

 

(2)        Fire lanes shall be established on private ways by agreements to be executed between the City and the private property owner in accordance with an agreement subject to the approval of the City Council.

 

(d)        Blocking the fire lanes prohibited. It shall be an offense for any person to block or obstruct a fire lane or any portion thereof by parking or stopping a vehicle thereon or allowing a vehicle to stand therein for any purpose whatsoever. Said fire lanes shall not be used by any private or commercial vehicle for the purpose of unloading or picking up cargo.

 

(e)        Ticketing, removal of vehicles. Any vehicle blocking or obstructing in whole or in part any fire lane is declared a fire and life safety hazard and a public nuisance. Such vehicles may be ticketed or removed from said fire lane by any officer of the Police or Fire Department and the owner of said vehicle shall be liable for all costs related to moving, towing or storing said vehicle and shall further be liable for any fine assessed in connection herewith.

 

(f)         Violations, penalty. Violation of any provision of this section shall, upon conviction of that offense, be punished by a fine of not less than fifteen dollars ($15.00) nor more than five hundred dollars ($500.00). (Ord. No. 75‑47, Secs. 1 ‑ 6, 8-4‑75)

 

Sec.171.5        Prohibiting the use of certain parts of West Hawkins Street

           

Section One:     That all traffic shall be prohibited from using West Hawkins Street between the

hours of 11:00 a.m. to 1:15 p.m. Monday through Friday, commencing September 1, 2001 and

continuing through June 30, 2002, at which time said restriction shall terminate. (Ord. 2001-49,

Section Two:  That the Administrators of St. Martin’s School may barricade said section of West

Hawkins Street for the above referred to hours and are authorized to allow students to utilize said roadway as a playground.

Sec. 32-172.1. No parking at Intersections.

 

No parking at any time within 100 feet of certain intersections.

 

(a)        It shall be unlawful for any person, firm or corporation to park or permit to be parked a motor vehicle at any time on the following designated streets within one hundred (100) feet in any direction of the intersection of the following named streets:

 

Maple Street at Nelson Avenue.

 

River Street at Harrison Avenue.

 

Station Street at Curtis Avenue, Wall Street, Washington

Avenue (FAP 45) and Harrison Avenue (FAP 26 ALT).

Sec. 32‑173.1. Vacation of Alley.

 

A public alley in the re-subdivision of Block 24, of the Hobbie Heights Subdivision for greater enjoyment and more beneficial use of the property. (Ord. 88‑35, Sec. 1 - 2, 9-6‑88)

 

The public interest of the City of Kankakee will be served by the vacation of that portion of a public alley lying between Lots 3 and 9, in Block 6, West Kankakee First Subdivision, and further defined as follows:

 

All that part of the 20-foot wide ally lying between Lot 3 and the East Half of Lot 9 in Block 6 in the Subdivision of part of the Northeast Fractional Quarter of Section 1, Township 30 North, Range 15 West of the Second Principal Meridian, as platted by Len Small, May 26, 1902, in Kankakee County, Illinois, also known as West Kankakee First Subdivision in the City of Kankakee, EXCEPT the North 10 feet thereof.

 

 Said vacation shall be subject to the following conditions:

 

(A)       The reservation of a perpetual easement in favor of the City of Kankakee and all public utilities for maintenance, repair and construction of all such public utilities existing on this date and recorded across, beneath and upon said vacated portion of said public alley;

 

(B)       The paving of all adjacent parking areas utilized by the applicant in the day-to-day operation of the principle use of the property (tavern), in accordance with the provisions of Chapter 10 of the Kankakee Zoning Ordinance/1995, as amended; and

 

(C)       The placement of parking blocks, or other similar structures approved by the City Engineer, along the South line of that portion of the public alley to be vacated, and along the South property lines of each adjacent lot utilized for off-street parking by the applicant. That the public interest of the City of Kankakee will be served by the vacation of a public alley lying in Block 32 of the Town of Kankakee City, and further defined as follows:

Tract 1:  All that part of Industrial Avenue lying between Blocks Three (3) and Four (4) of Hobbie Heights addition to the City of Kankakee, Illinois, lying between the North right-of-way line of Court Street and the Southwesterly right-of-way line of the New York Central Railroad;

 

Tract III:  All that part of the East/West alley in Block Four (4) of Hobbie Heights Addition to the City of Kankakee, Illinois. Lying between the East right-of-way line of Industrial Avenue and the Southwesterly right-of-way line of the New York Central Railroad;

That the public interest of the City of Kankakee will be served by the vacation of a portion of a public alley lying in Block 8, Town of Kankakee City, as all shown on a plat of vacation which is attached hereto and made a part hereof, and further described as follows:

 

The South 200 feet of an alley in Block 8 in the Town of Kankakee the City, now the City of Kankakee, Kankakee County, Illinois, lying between the South line of said Block 8 and the North line of Lots 9 and 10 in said Block 8.

 

That this Ordinance is passed pursuant to the recommendation of the City of Kankakee Planning Board, made at its May 18, 1999 public hearing.

 

That said vacation shall be subject to the following conditions:

 

1.         The reservation of a perpetual easement in favor of the City of Kankakee and all public utilities for maintenance, repair and construction of all such public utilities existing on this date and recorded across, beneath and upon said vacated portion of said public alley.

 

2.         The recording, by the applicant, of a restrictive covenant on the property to include a 35-foot ingress/egress easement along the North end of the subject property, to be described as follows:

 

Being the North 35-feet of Even Width of Lots 9 and 10, and the North 35-feet of the Vacated Alley, Lying Immediately South of the North Lines of Lots 9 and 10 Extended, All in Block in the Town of Kankakee City, now the City of Kankakee, in Kankakee County, Illinois.

 

Property Owner is Responsible for Maintenance or Repair of Roadway Within Said Easement.

 

That this Ordinance shall be effective upon its passage, approval and publication in pamphlet form in the manner provided by law. (Ord. No. 99-45, Sec. 1-4, 6-7-99).

 

That the public interest of the City of Kankakee will be served by the vacation of a portion of a public street and alley lying in Block 1, Middle Kankakee in the City of Kankakee, as all shown on a plat of vacation which is attached hereto and made a part hereof, and further described as follows:

 

TRACT 1.         That part of North East Avenue lying West of and adjacent to Lots 5 and 6, Block 1 in Middle Kankakee, in the City of Kankakee, Illinois; and

 

TRACT 2         That part of the alley lying between Lots 5,6, 17, and 18, Block 1, Middle Kankakee, in the City of Kankakee, Illinois.

 

That this Ordinance is passed pursuant to the recommendation of the City of Kankakee Planning Board, made at its April 18, 2000 public hearing.

 

That said vacation shall be subject to the following condition:

 

The reservation of a perpetual easement in favor of the City of Kankakee and all public utilities for maintenance, repair and construction of all such public utilities existing on this date and recorded across, beneath and upon said vacated portion of said public alley.

 

That pursuant to Illinois Compiled Statutes Chapter 765, Section 205/6, et/ Seq., the written instrument of Jacqueline Celo, Patricia Linton, and Suzanne Linton, as attached hereto and made a part hereof, vacating that portion of the plat of Middle Kankakee to the City of Kankakee, Illinois, containing the aforesaid 100-foot public street and alley, be and is hereby approved. 

 

That this Ordinance shall be effective upon its passage, approval and publication in pamphlet form in the manner provided by law. (Ord. No. 2000-39, 5-1-2000)

 

That the public interest of the City of Kankakee will be served by the vacation of a portion of Industrial Avenue and a public alley lying adjacent to Blocks 25 & 26, Hobbie Heights Addition to the City of Kankakee, as all shown on a plat of vacation which is attached hereto and made a part hereof, and further described as follows:
