I. LIBRARY
Sec. 20‑01. Library
Established.
A public library and reading room for the
use and benefit of the inhabitants of the City is hereby created and
established, to be known as The Kankakee Public Library, referred to in this chapter
as the library. (Code 1965, Sec. 4‑13)
Sec. 20-01.1. Library declared historic site.
(a) Upon the recommendation of the Historical
Preservation Commission, It is the findings of the City Council of the City of
Kankakee that the Kankakee Public Library situated on the southeast corner of
the intersection of Station Street and Indiana Avenue in the City of Kankakee
is of unique historical value and its preservation is necessary to the beauty
and culture of the City.
(b) The Kankakee Public Library is hereby
designated an historical landmark and is therefore under the authority of the
Kankakee Historical Preservation Commission created by Ordinance No. 85‑43.
(c) No alterations, interior construction
which affect structural members, exterior construction or exterior demolition
may be performed on said structure, except as shall be approved by a
certificate of appropriateness. (Ord. No. 89‑06,

Sec. 20‑02. Tax
levy for library.
For the purpose of maintaining the public
library, it shall be the duty of the City Council to levy a tax of not to
exceed two (2) mills on the dollar annually on all taxable property of the
City, which tax shall be levied and collected in like manner with the general
taxes of the City, and shall be known as the library fund. (Code

Sec. 20‑03. Board of directors for library.
The board of directors for the library shall
consist of nine (9) directors. The Mayor shall be a member and he shall appoint
the other eight (8) members. The other directors shall serve for three (3) year
terms. The Mayor shall, on or before May first of each year, appoint directors
to take the place of retiring directors, who shall hold office until their
successors are appointed. (Code 1965, Sec. 4.13; Ord.

Sec. 20‑04. Powers of board of directors - library.
The board of directors for the library
shall have the exclusive control of the expenditures of all moneys credited to
the library fund and of the construction or leasing of any building or rooms
set apart for the purpose of a public library and reading room, and shall have
the supervision, care and custody of the same. They shall also have power to
purchase or lease grounds, to occupy, lease or erect a building or rooms for
the use of the library and to provide the necessary furniture and fixtures for
the same to make and adopt such by laws, rules and regulations for their own
guidance and for the government of such library and reading rooms as may be
expedient; to appoint a suitable librarian and assistants if necessary, and to
fix their compensation, and shall in general have such powers as may best carry
out the spirit and intent of this section in establishing and maintaining a
public library and reading room. (Code 1965, Sec.4‑13)
Sec. 20‑05. Annual report - by library board.
The board of directors for the library
shall, on or before the close of business on May 15, make an annual report to
the City Council, stating the condition of their trust on the first day of May
of that year. (Code 1965, Sec. 4‑13)
Sec. 20‑06. Employees' retirement - Library.
Every library employee shall be retired
at the age of sixty-five (65) years, which limit shall be extended only by a
majority vote of the board of directors. (Code 1965, Sec. 4‑13)
Sec.20‑07. Use of facilities in the library.
The public library shall be free to the
use of the inhabitants of the city, subject to such regulations as the board of
directors may adopt. The board may in its discretion extend the use of the
library to persons outside the City upon such terms and conditions as the board
may prescribe. (Code 1965, Sec. 4-14)
Sec. 20‑08. Library fund.
All moneys collected for the use of the
library by taxation, and all moneys collected by gift or donation, unless
otherwise provided, shall be deposited in the city treasury, and shall be kept
separate and apart from other moneys therein, in a fund to be known as the
library fund, to be drawn upon by the proper city officers, upon the properly
authenticated vouchers of the library board or its authorized officers, in the
same manner as salaries of city officers are paid. (Code 1965, Sec.4‑14)
Sec. 20‑09. Injury
to property of library prohibited.
No person shall willfully or maliciously
cut, write upon, injure, deface, tear or destroy any book, newspaper, picture
or other property belonging to the library. (Code 1965, Sec. 4‑14)
Sec. 20‑10. Failure to return library material.
Any person who shall fail to return
loaned library material or materials, including, but not limited to, books,
tapes, videotapes, periodicals, magazines, artworks, phonograph records or
recordings or compact discs and the like, at the time and according to the
rules and regulations adopted by the Board of Directors, shall in addition to
the cost of said material, be liable for a fine of not less than Fifty Dollars
($50.00) and not more than Five Hundred Dollars ($500.00). Said fine shall be Fifty Dollars ($50.00) if
paid within fourteen (14) days from the date of such notice hereof, One Hundred
Dollars ($100.00) if paid within thirty (30) days of the date of notice and if
not paid within thirty (30) days, it shall be determined by the Administrative
