CITY COUNCIL MEETING

DECEMBER 15, 2008      7:01 P.M.

 

MAYOR GREEN:       I’d like to call the meeting to order, please.  I’d like to ask Reverend Danny Chandler from the New Faith Community Baptist Church to come up and open our meeting with a prayer.

 

REVEREND CHANDLER:     I’m sorry, I didn’t hear you. Did you call me?

 

MAYOR GREEN:       Yes, I did.

 

REVEREND CHANDLER:     Okay.  I didn’t hear you.  But, I gotta’ say somethin’.  I just can’t help it.  Everybody here is healed tonight.  The Lord did send me to make sure everybody get healed.  Everybody on the City Council.  Man, I thank God.  So, let us pray, you’al.  Eternal God, Father in heaven, Lord, we just come only ways we know how.  Say thank You.  Thank You, oh God, for allowing us to come together.  Lord, we thank You for these leaders, we thank You for our Mayor, we thank You for all that make up this gathering, oh God.  And, we pray that You would just bless they families, bless they children, bless everything that they do, oh God.  And, Lord, we first got to say how much we love You.   We love You with all our heart, with all our mind, with all our soul, with all our strength.  And, we love our neighbor as ourself.  And, we thank You.  Now, Lord, we axe, oh God, as they prepare to look at the business that they are on they hearts, oh God, the things that they are want to do and get done, oh God, help them, oh, God, that they might be able to have the patience and the understanding that allow the business to go for.  Lord, then we axe, oh God, so many maybe of ‘em not even know You.  Oh God, we pray oh God, that You would help them to get to know You because knowin’ You is knowin’ everything.  And, we thank You, oh God.  We pray, oh God, somebody might indistinguishable God in this, but not in the power indistinguishable.  But, we pray, oh God, that you would just help them, oh, God, to get to indistinguishable. You said, if thou will confess with thy mouth to Lord Jesus and believe in thy heart that God has raised up from the dead, thou shall be saved.  And then, Lord, we pray, oh God, Lord, that You would just help them be on one accord, oh God, that they can move forth, stand behind this Mayor, oh God.  Stand behind the Aldermens, oh God.  Let everybody be constituents, oh God.  Every neighborhood, oh God.  We just thank You.  We just praise You.  Now, Lord, let everything work together.  You said all things work together for the good of them that love You and them that are called according to Your purpose.  Now, Lord, bless the things that they do tonight, oh God.  Help them to get things done in a decent order, oh God.  Help them to be patient, the ones, oh God, that really think it’s somethin’ important to get done, help them, oh God, to be patient that it might move forth because we know that You the only one can get it done.  Now, Lord, help everybody to look to You, oh God.  And, we thank You right now in Jesus’ name.  Amen.

 

MAYOR GREEN:       Now, I’d like to ask the varsity team from Kankakee High School to come up and lead us in the Pledge.  The championship team from Kankakee High School.  Over here is the flag, gentlemen.

 

KANKAKEE HIGH SCHOOL VARSITY FOOTBALL TEAM AND ALL:   Pledge of Allegiance

 


MAYOR GREEN:       Now, wait, stay up here.  Stay here.  Stay here.  We’ve got........we have a Resolution that we’d like to introduce tonight for the team and I’m going to ask the City Clerk if she’ll read that to you and so we can adopt it.

 

CLERK DUMAS:        RESOLUTION NO. 2008 - 36  HONORING THE KANKAKEE HIGH SCHOOL VARSITY FOOTBALL TEAM  WHEREAS, the 2008 Kankakee High School Varsity Football Team has enjoyed a successful season which sent them all the way to the State Semifinals Class 5A playoffs, representing a first for the high school.  The young men who make up this team have brought pride to the City of Kankakee and have proven that with hard work and a positive attitude, success is attainable.  Tim Ahrens, sportswriter for The Daily Journal, has stated that there is no jealousy on this team: “No player I talked to wanted to take credit for the wins.  Running backs Jalon Banks and Runder Smith said they didn’t care who carried the ball; they just wanted to win.  They also credit their linemen.   Receiver Julian Bogan said the team was a family and his teammates were his brothers.”  More important than taking credit for the wins was the team’s attitude about how much better they had to play to get where they wanted to be.  The City of Kankakee will always remember these players, not only for the semifinals, but for the character, strength, and fortitude it took to get them there.  The “Go, Kays!” signs which were displayed all over town are something which this community has not seen for a long time, and we want to thank this team for giving the citizens the chance to celebrate a positive accomplishment for this City.  The City of Kankakee would like to congratulate these players.  Praise is also due to the superb coaches and trainers.  THEREFORE, BE IT RESOLVED by Mayor Donald E. Green and the City Council of the City of Kankakee, do recognize and honor the Kankakee High School Varsity Football Team and their coaches for the distinction they have earned as the most successful squad in the high school’s history, and for the commitment, teamwork, and values they have displayed.  Congratulations, Kays!

MOTION TO APPROVE CITY COUNCIL MEETING MINUTES OF DECEMBER 1, 2008

 

MAYOR GREEN:       Motion carries.  Ah, I’m going to ask Mr. O’Brien if he would come up.  He has a short presentation he’d like to make on the Chamber’s input to the Lakota Plan for the downtown portion.  So, the Floor is yours Mike. You and Bill.

 

MIKE O’BRIEN:         Thank you Mr. Mayor, members of the City Council.  Bill Yohnka, the Director of the Chamber, and I have a few comments to make about the comprehensive Downtown Master Plan and Bill’s going to say a few things first. 

 

BILL YOHNKA:         Each of you have a copy of this and this is all a preliminary copy.  We’ve, ah, been working on this and as you know the history in 2000, this was done for the first time.  And, there’d been a........before I took my current position, there was kind of an update in the works.  And, ah, that’s kind of what you see here is the more finished version of that.  And, ah, really what it is, is it’s another look at our downtown plan and taking into consideration the progress that we have made in that.  So, ah, tonight this is just here for your consideration to look over and, ah, hopefully be approved at a future meeting.  But, we just wanted to, ah, let you see what we’ve been working on and, ah, it has been a nice partnership between the City, KDC and, the new Kankakee Chamber of Commerce which has kind of been a subcommittee that’s taken the lead on this project and, ah, I owe a lot of the credit to Mike O’Brien who’s kind of help to organize people to take a second look at this and to get some fresh eyes to see this project.  So, I’ll turn it over to, ah, our Board Chairman, Mike.

 

MIKE O’BRIEN:         Thanks Bill, and thanks again.  The Chamber really viewed this as an opportunity and was privileged to be the, sort of the one, the group to do the legwork on this project and it took a long time and there’s lots of details in here and we tried to be as thorough as possible so when we presented it to the City, it was something that would be beneficial and ultimately be able to be approved and, most importantly, be implemented.  And, we, the Chamber of Commerce, really views this as the roadmap to build on the successes of the 2000 plan, to update it and to make sure that this is a roadmap for future growth in the downtown area and the area surrounding downtown.  So, it’s our hope that the City and the County and private enterprise within our community can use this as a roadmap and really come together as we work on a plan ultimately that the City approved and it can be a success for future years.  And, as a Chamber, it’s our hope that we can serve a role as sort of making this happen.  Once it is approved, the final product, we want to be the ambassadors for the City, the ambassadors for this plan to private industry and get our members and bring new members to town and make this plan a reality.  So, we thank you for that opportunity.  We want to continue to be involved.  We appreciate the opportunity.  And, there’s a number of members of the Chamber here.  Alderman Hunter is a board member and a few others are here so it’s a group that’s really interested in what’s going on in downtown and know that there’s more good things ahead.  So, thank you very much.

MAYOR GREEN:       Ah, next, I’m going to call on Carl

 

ALDERMAN BROWN:          Mr. Mayor.

 

MAYOR GREEN:       I’m going to ask Carl Brown to come up.  We have a special presentation we want to make tonight to the Department of Public Works so, Carl, the microphone’s yours.

 

ALDERMAN BROWN:          Thank you, Mr. Mayor.  Aldermen, the reason I’m going to do this is for two reasons.  The first reason is that people at indistinguishable the City of Kankakee indistinguishable and they never give.......no one ever says thank you.  They say thank you to us sometimes and to elected officers, but for some reason, these people go out and they always are the first responders.  Like the snow storm that we had last year.  Those people was out 24 hours a day sometimes.  And, no one said, ah, thank you to them.  We said indistinguishable.  Tonight, I just want to recognize those people, so I just want Bert Dear to come forward and indistinguishable.  I would like for all the workers from Public Works to just step forward.  I don’t know about you, but when I have a problem, Dennis is the first person I call.  And, these people that you see before you take care of your business.  When I have a grass problem I call you.  When I have a street problem, I need a hole fixed, I call him.  When I have snow removal in a certain area, I call him.  So, tonight, I just want to say thank you.  And, I want to present this plaque to your department.  And, it simply says, The City of Kankakee Appreciation Award to Department of Public Works.  The Appreciation Award is presented to Department of Public Works for the outstanding work performed during the 2008 snow and tree removal within the City of Kankakee.  The award is given to show our appreciation of dedication and commitment that this department has shown with the quality of service that it provides to the residents of the City of Kankakee.  And, we just want to say thank you.  Dennis, this is for you.....Bert, Bert......

 

MAYOR GREEN:       There is a little difference.

 

ALDERMAN BROWN:          That’s for you and this is your certificate and Dennis, this is your certificate and what I’ll do is I’ll present the certificates to you, Bert, and you can give them to all the members of Public Works.  But, I just wanted to say thank you.

 

MAYOR GREEN:       Absolutely.

 

BERT DEAR:   When Carl Brown first mentioned that he’d like to do something for the department, my response was this is what we do.  But, these guys are out a lot and every once in a while the Mayor’ll give us a letter from someone in the community tellin’ him thanks for the snow storms, trees, and many other different things.  I mean, they might be doin’ one thing and stop from patchin’ to go remove a tree or just so many different times they call for a barricade or whatever, you know, but these guys, very seldom do they come together like this.  They all on a truck doing different jobs.  They do a good job.  And, some of ‘em are thirty, thirty-five years and I mentioned to one of the guys this morning, come here, Dennis, please.  And, I’d like you to just tell them what you said.  He said about coming to Council meeting tonight. 

 

DENNIS BOWSHER: Been here thirty-five years.  This is the first time they’ve ever thanked us publically.

 

BERT DEAR:   I’d like to say thank you all.  Really.  They do a good job.

 

ALDERMAN BROWN:          That’s not all.  Hold.....hold.....hold. 

 

MAYOR GREEN:       Dennis, sometimes we’re a little slow.

 

ALDERMAN BROWN:          Alderman Cheryl Jones got a present to present to you guys, too.

ALDERMAN JONES:             Last year I brought you guys coffee and tea and cookies.  This year–a little help here–I do appreciate everything you guys have done in my Ward indistinguishable and plowing our streets and keeping it safe for everybody.  I do appreciate what you guys do.

ORDINANCE APPROVING THE ANNEXATION OF APPROXIMATELY .25 ACRES

MAYOR GREEN:       Motion carries.  Ah, next, we’ve already done the Communications.  Standing Committees.  Public Safety.

 

ALDERMAN HUNTER:         They’re self-explanatory.

 

MAYOR GREEN:       License and Franchise.

 

ALDERMAN SWANSON:     The information is in the packet.

 

MAYOR GREEN:       Alderman Brown, you have an issue you need to bring up from the DPW meeting.

 

ALDERMAN BROWN:          Yes, Mayor.   indistinguishable that nobody bid on the salt and what we need is....

 

MAYOR GREEN:       That’s the fuel, you mean.

 

ALDERMAN BROWN:          Fuel, I’m sorry, the fuel bid.  Sorry.  Salt indistinguishable. What we’d like to do, we’d like for our present provider to continue to provide us the fuel that we need at the same price and we’ll rebid our fuel bid and, hopefully, they’ll have that bid ready for the full Council by the first or the second meeting in January.  So, I’ll make that in the form of a motion.

MAYOR GREEN:       Yeah, our contract runs out this month, so we need to do that until we get a new bid.  So, we’re just asking your permission to use the current contract...... to extend it.

 

ALDERMAN JONES:             Second.

 

MAYOR GREEN:       Carl made the motion.  Alderman Brown made the motion, Alderman Jones seconded it.  Any questions?  Alderman Epstein.

 

ALDERMAN EPSTEIN:         Was the bid advertised?

 

MAYOR GREEN:       Yes.

 

ALDERMAN EPSTEIN:         And, no one responded to the bid?

 

MAYOR GREEN:       Correct.  Alderman Diersen.

 

ALDERMAN DIERSEN:        Is that bid for a certain amount all during the year regardless of the price or how does that bid work?

 

MAYOR GREEN:       It’s a floating rate.  It’s a floating amount.  It goes up and down depending on the cost of fuel.  And, I’m sorry, I don’t have the contract here, but it depends  on what the cost of fuel is.  There’s a formula that’s applied to it.  It’s the same contract we’ve had no matter who it’s been with.  It’s the same issue.  That’s the best I can answer.  Bert, I don’t think, is here.

 

ALDERMAN DIERSEN:        I’m just surprised we wouldn’t have anybody bidding on it if that’s the case.

 

MAYOR GREEN:       We were surprised, too.  The new bid was to take effect December 31, and of course now it can’t.  Roll call.

MAYOR GREEN:       Motion carries.  Next, under Unfinished Business, ah, we’ve got......the first item is the Ordinance levying property taxes for all corporate purposes for the City of Kankakee commencing May 1, 2008, ending April 30, 2009.  This is the second reading.  I need a motion to approve.

 

ALDERMAN HUNTER:         Mayor Green, with the Council’s permission, all of these are second reading.  I would request that items 10 A, B, C, D and E be approved indistinguishable.

 

MAYOR GREEN:       Is there a second?

 

ALDERMAN BARON:           Second.

 

MAYOR GREEN:       Motion by Alderman Hunter, seconded by Alderman Baron that we approve on second reading items number 10 A, B, C, D and E, which all have to do with the levies for the period of May 1, 2008, ending April 30, 2009.  Any questions?

ALDERMAN JONES:             Was the.........there was a hearing on this and how many people came?

 

MAYOR GREEN:       That’s correct.  I don’t have the minutes.  How many were there Mr. Spice?

 

JAMES SPICE:           I believe there were about a dozen.   indistinguishable accurate count.

 

UNKNOWN:  Fourteen.

 

MAYOR GREEN:       Fourteen less myself, Jim Spice and Anjanita.  So, there would have been eleven people there.  I think in all honesty the biggest question that came up was the issue they were concerned about the assessments of their property and we said the City doesn’t do any assessing of property.  So, that was the discussion.  And, of course, no one likes taxes.  I guess that’s a given, right?  Any other questions?  Roll call.

“EAST SIDE BUSINESS DISTRICT” FOR THE FISCAL YEAR COMMENCING ON

MAY 1, 2008 AND ENDING APRIL 30, 2009

 

MAYOR GREEN:       Motion carries.  Next, under New Business, we have an Ordinance for Handicapped Parking at 430 S. Harrison Avenue. 

 

ALDERMAN SCHWADE:     I so move.

 

ALDERMAN JONES:             Second it.

 

MAYOR GREEN:       Motion by Alderman Schwade, seconded by Alderman Jones, to Suspend the Rules that would interfere with the passage of this Ordinance.

ORDINANCE AMENDING CHAPTER 32, SECTION 231 ESTABLISHING A

HANDICAPPED PARKING SIGN AT 430 SOUTH HARRISON AVENUE

 

MAYOR GREEN:       Motion carries.  Next, is the recommendation to accept the 2009 calendar for the regular meeting of the City of Kankakee and also, we could deal with B and C together, if you so desire.  It’s the recommendation to accept the 2009 calendar dates for the Historic Preservation Commission.

FOR THE FOURTH FLOOR OF THE KANKAKEE PUBLIC LIBRARY  

 

MAYOR GREEN:       Motion carries.  Ah, there are no appointments.  We’ve already dealt with the Resolution for the High School and we need to establish an easement for the use of real estate for HomeStar Bank.  This is the parking within our lot that will serve that bank.  So, we’re asking your approval on that.

 

ALDERMAN SCHWADE:     I move to accept the Resolution for establishment of an easement for the HomeStar Bank.
